Climate change deniers wallets threatened Ken Perrott Apr 22

Apparently climate scientist Michael Mann has threatened legal action* against Minnesotans for Global Warming (M4GW) over their  video “Hide the Decline.” This used the comment from the “climategate” emails to portray a dishonest and slanderous picture of Mann. The video has been heavily promoted by climate change deniers and conservative  groups, news outlets and blogs internationally. Several conservative NZ bloggers promoted the video.

So far I have only seen the M4GW press release which is somewhat cavalier. However, they have taken the video down from YouTube. When asked why he removed the video, M4GW’s Elmer Beauregard said “Right now, the last thing I need is a lawsuit. I can barely afford my electric bill.” The fact that they have replaced it with another revised one, “Hide the Decline 2,” suggests they had something to fear from Mann’s “cease and desist” order.

Science confirmed sound

All the inquiries into the “climategate” affair are confirming that, despite questions over freedom of information requests,  there was no inappropriate scientific behaviour involved. In fact, it was rather silly to believe that any had occurred given that this is one of the most scrutinised and reviewed areas of science.

So, if this legal threat develops further courts would likely find in Mann’s favour. These irresponsible climate change denial campaigners may face the financial reality of their slanderous behaviour.

Legal action by scientists is unusual. Perhaps we are naive but the usual response to criticsm is to present evidence. However, the “climategate” campaign has brushed aside evidence and reason. It has been basically hysterical and nasty. Honest scientists have been abused, misrepresented and defamed with seemingly no conscience.

NZ denial campaign

We have seen the same situation in New Zealand. A conservative cabal of climate change denial conspiracy theorists (eg. Ian Wishart and Richard Treadgold), conservative bloggers, the ACT Party and right wing political groups such as The Climate Science Coalition, the Climate Conversation Group , and the Centre for Political Research have coordinated their activity recently. They attacked New Zealand NIWA scientists by producing and circulating a dishonest  report. This claimed that scientists “created a warming effect where none existed.” That “the shocking truth is that the oldest readings were cranked way down and later readings artificially lifted to give a false impression of warming.” And “we have discovered that the warming in New Zealand over the past 156 years was indeed man-made, but it had nothing to do with emission of CO2 – it was created by man-made adjustments of the temperature. It’s a disgrace.” (see New Zealand’s denier-gate).

So, perhaps this is the future. Now that the “climategate” hysteria is settling, now that inquiry after inquiry shows no evidence of scientific misbehaviour, perhaps the chickens can come home to roost. Perhaps those responsible for the nastiest aspects of this hysterical campaign can face the financial consequences of their behaviour.

I say – bring it on! And wouldn’t it be nice if some of those in New Zealand who participated and encouraged this nasty campaign faced similar threats to their back pockets.

New Zealand’s climate change deniers’ distortions exposed. Ken Perrott Dec 05

I am pleased to see that the attempt to promote a New Zealand version of “climategate” has more or less foundered. Sure the ACT party and some more extreme opponents of the findings of climate scientists are still campaigning (see for example Auckland Public Meeting: Climategate, NIWA and the ETS). And well know local climate change denier Ian Wishart managed to get international reporting of his slanderous press release (BREAKING: NZ’s NIWA accused of CRU-style temperature faking) in several more conservative and extreme international blogs and papers (for example BREAKING: NZ’s NIWA Accused of CRU-Style Temperature Faking, Climategate Scandal Spreads to New Zealand as MSM Continues Ostrich Act, Oops! Now New Zealand NIWA Accused Of Faking Data, New Zealand’s NIWA Gets Busted “Tricking” Their Climate Data and New Zealand Climate Data Shows Clear Evidence Of Fraud). But the New Zealand media has, in general, been more balanced in its reporting. The information from climate scientists at NIWA has been getting through.

Temperature trends for raw data

For example, NIWA’s information on the temperature trends shown by raw data from 11 local  met stations (Temperature trends from raw data) has been picked up (Niwa publishes climate data to answer critics). NIWA released this because of the distorted information distributed by the NZ Climate Science Coalition, the Climate Conversation Group and Ian Wishart (Climate change deniers live in glass buildings ).

Some local bloggers picked up and reproduced this misinformation. In the process they have been slandering our local climate scientists and other bloggers who have attempted to correct the misinformation. My personal concern in this is not so much the facts of climate change, but the willingenss of some ideologically driven people to unjustly attack the integrity of honest scientists. And their willingness to distort information with this end in mind.

So it’s worth reproducing some of the latest information released by NIWA.  This uses publicly -accessible information (from the National Climate Database). The data used is from the period after 1930 when there were no significant site changes. Consequently the raw data could be used without adjustments to determine temperatures at the individual sites. (You will recall that the climate change denier’s report and press release claimed that NIWA’s adjustment of data to accommodate met station site changes was fraudulent. And that they (the deniers) went ahead to combine data without adjustments and produced a misleading graphic suggesting temperature was unchanged over time. The current data should avoid all issues of adjustments).

NIWA’s information says in part:

We have analysed raw data from these sites directly, with absolutely no adjustments to the numbers from the NIWA climate database. Taking all sites together and averaging the annual mean temperatures (difference from 1961–90 mean at each site) results in Figure 1 below.

Note that not all stations have annual mean temperature values for all years in 1931–2008. It is common practice to in-fill isolated missing months, but we have deliberately not in-filled missing data here to keep this analysis as non-contentious as possible. For each year, the available station values have been averaged. In the title of the Figure, the “p-value” comes from a statistical test, and indicates the probability that the indicated trend could have arisen by chance.

If the two outlying Island records (Raoul and Campbell Islands) are left out, and the remaining nine records averaged, the result is as shown in Figure 2. In either case, the trend over the 78 year period is close to 1°C.

BCA libels Simon Singh? Ken Perrott Oct 16

Update to A victory for Simon Singh.

Apparently the British Chiropractic Association (BCA) have given way to emotion in a public commen on Simon Singh’s small legal victory. In a press release (see BCAStatement 14 10 09) they claim that “the BSA was maliciously attacked by Dr Singh in the Guardian article.” Jack of Kent comments that this amounts to defamation and Singh could now counter sue (see BCA Defame Simon Singh). The BCA obviously realised this because they quietly withdrew and rewrote their press release (see BCA Statement 15 10 09).

This development could mean the BCA has drastically weakened their case.

A victory for Simon Singh Ken Perrott Oct 16

Simon-Singh-002Science writer Simon Singh has won a victory in his chiropractic libel battle!

I initially discussed his case in Suppressing science. Briefly, Singh was being sued for libel by the British Chiropractic Association (BCA) because of an article of his in the Guardian. In this he referred to the chiropractic profession happily promoting “bogus treatments.” See Beware the Spinal Trap for the text of Singh’s article.

Back in May the British High Court ruled on the meaning of the  words claiming they implied the BCA was deliberately dishonest. Singh contested this saying this was not his meaning and that the ruling would make it difficult to defend himself in a trial. He was refused leave to appeal against the ruling in two court hearings.

Now this interpretation has been rejected in another Appeal court hearing.

This means that he can now proceed to appeal  that his article was fair comment. And the hearing will no longer be limited to interpretation of meaning.

Singh described the ruling as the “best possible result.” However, there are still large legal hurdles to surmount.

This case has highlighted how British libel laws are stifling free expression and are in need of reform.  Singh’s experience has reuslted in a campaign to achieve that reform
